Where do we stand on email marketing and spam?

As an employee of a marketing agency, I have a hard time supporting Hong Kong’s tough new anti-spam law (via), which essentially states that if you didn’t request the information, it’s illegal - even if a prior business relationship exists. As a person, however, I think I would give money to any political candidate that promised to push legislation like this through in the America.
Unfortunately, though, it’s not that easy. As the article points out, what about safety recall notices? Under the new law, these would technically be illegal.
There are many gray areas like this to consider, and as an agency, we need to come up with our philosophy toward email marketing and spam and where the two things intersect and diverge.
